What is a Guardian?
A guardian is someone to bring-up your children in the unlikely event you can’t.
If you have young children, you’ve probably had thoughts about who would bring them up if for some reason you or your partner couldn’t. It’s not the easiest thing to consider and many people just let it slip. However, by arranging a guardian in your will you can make the necessary arrangements to deal with this issue. You will then have the peace of mind from knowing that in the event you are not there to bring up your children, they will be cared for by someone you have chosen.
Naming a Guardian
You should name at least one guardian for each of your children and ideally a reserve in case the first choice cannot do it. You can name two people to care for your child but be aware of possible disagreements so perhaps only have two if they are a stable couple who would both act as parents.
Some factors to consider when choosing a Guardian
- Does the prospective guardian have a genuine concern for your children’s welfare?
- Is the prospective guardian physically able to handle the job, e.g. not too old for the role?
- Does he or she have the time?
- Can your prospective guardian afford to bring them up?
- Does the prospective guardian share your morals and values?
- Would your children have to move away from friends and relations?
Take the time to talk with the person you’re considering. Your candidate may not be willing or able to accept the responsibility, or their responses about acting as guardian may help you to make the decision.
What happens if there is no Guardian appointed?
In the absence of a person with legal parental responsibility the Social Services step in. They make decisions about your children until the matter is settled by a court. This additonal layer of uncertainty can be a massive extra burden on the children at a time when they would need maximum comforting and reassurance.
