<p>This has joint benefits I think for me and the DIY Will writer as follows:</p>
<p>(i) Lawscape can tap into the DIY Will market and</p>
<p>(ii) the check/review makes it a safer bet for those who choose the product.</p>

			<content:encoded><![CDATA[<p>It seems that in the United Kingdom the biggest reason for <strong>wills</strong> failing, i.e. being rejected for Probate, is down to defective attestation.</p>
<p>For a will to be properly attested (signed) there has to be two witnesses present who witness the attestation by the person making the will. In other words these two witnesses must actually see the will being signed.</p>
<p>As a matter of good practice, I advise the witnesses that for the next few minutes they must stay in the room, switch off their mobiles and await my instructions. This helps prevent them wandering off and, hopefully, after I have explained to them exactly what they have to do they will have a clear idea of their role. The two witnesses should then sign the will confirming that they have witnessed the signature by the testator.</p>
<p>This failing is most frequently found when <strong>DIY</strong> wills are presentedfor Probate. The proper procedure  is surely mentioned in the instructions of the DIY will package but the potential for missing this one vital point is very high.</p>
<p>My Professional Indemnity insurance requires me to be at the attestation just to avoid this common mistake.</p>

<p>If it&#8217;s a gamble on doing a DIY Will that is another matter. You can save a bit of money now but the cost to your family in terms of emotional turmoil and potential disputes could be enormous.</p>
<p>making a Will is not for your immediate benefit but it can give you real peace of mind but probably only if you use a professional to do it for you.</p>

			<content:encoded><![CDATA[<p>I have just seen the cheapest version of a DIY Will kit yet. I was posting a letter in the Box Post Office in Corsham (which in Wiltshire and just a few miles from Bath for those who don&#8217;t know). I noticed a poster advertising a DIY Will kit for just £9.99. Well that beats the one for £15 in WH Smiths I suppose.</p>
<p>For many people the appeal of this cheap route to making a Will may seem like an excellent idea but if you don&#8217;t get it right the results could be disastrous.</p>
<p>Now I am not saying it can&#8217;t be done adequately using the DIY route. But on the other hand most Wills are found to be invalid through procedural defects such as problems with the signing procedure or through improper amendments to the Will. This sort of fault would not happen if properly supervised by a professional.</p>
<p>Also, without the proper fact finding and advice that you would receive by using a professional,  there is real potential for missing out on important benefits e.g. using the right type of Will Trust to protect your property.  In addition there may be ways of saving Care Home fees,  Inheritance Tax or even ensuring your children can still inherit if you die and your partner remarries. There are many issues that can be of real importance but do you understand what they are?</p>
<p>And what happens if there is a mistake? Your loved ones will find out after you have died and it would be left to them to  &#8216;pick up the pieces&#8217;. There is no Professional Indemnity insurance to fall back on either.</p>
